GST Annual Return – GSTR – 9

Form GSTR – 9 is an annual return to be filed once for each financial year, by every registered taxpayers who were regular taxpayers, including SEZ units and SEZ developers. The taxpayers are required to furnish details of purchases, sales, input tax credit or refund claimed or demand created etc. in this return.

Composition taxpayers can file their Annual Return in Form GSTR – 4, which is due by 30th of the April following the relevant financial year.

Pre-conditions for filing of Form GSTR-9 are:

  • Taxpayer must have active GSTIN during the relevant financial year as a normal / regular taxpayer even for a single day.
  • Taxpayer must have filed all the applicable returns i.e. Form GSTR-1/IFF and Form GSTR-3B of the relevant financial year before filing the Annual Return.

Exceptions:

It is mandatory for all the registered taxpayers under GST to file their annual GST returns, subject to following exceptions:

  1. Input Service Distributors.
  2. Taxpayers opting for Composition Scheme.
  3. Casual Taxable Person.
  4. Non-resident Taxable Persons.
  5. Persons paying TDS under Section 51 or TCS under Section 52.
  6. Persons supplying OIDAR services from out of India to a person in India.

“NIL” GSTR – 9 Return can be filed, if you have:

  • Not made any outward supply (commonly known as sale); and
  • Not received any inward supplies (commonly known as purchase) of goods/services; and
  • No liability of any kind; and
  • Not claimed any Credit during the Financial Year; and
  • Not received any order creating demand; and
  • Not claimed any refund.
